Sale Terms and Conditions of and Website Terms of Use

INTRODUCTION

These terms and conditions (Terms) are between us Book With Us and you, the person visiting the Site or placing an Order for Products through the Site.

Clause 1. APPLICATION

1.1 APPLICATION OF TERMS

These Terms, as well as the Product Specific Terms applicable to each Product, apply to the use of the Site, including for the sale of all Products offered by Book With Us on the Site, which Book With Us undertakes on behalf of its partners. Book With Us may, at any time and at its discretion, vary these Terms by publishing varied terms on the Site. Prior to placing an Order, we recommend you carefully read the terms that are in effect at that time to ensure you understand and agree to them. For any Order that has been accepted by Book With Us, the terms and conditions that apply will be the ones that were in effect (and which you agreed to) when you placed your Order.

Clause 2. USE OF THE SITE

You accept these Terms, as well as any Product Specific Terms, by accessing the Site, placing an Order via the Site, including by reviewing and accepting the Terms by click-box prior to each Order, or by accepting these Terms by phone or email.

2.1 USE OF THE SITE

Conditions of use
You must not use the Site and/or place an Order for Products through the Site unless you are at least 18 years old.
 
You are responsible for the use of the Site, including any Orders placed for Products made on the Site for you, or on behalf of a third party (including minors), except when your useof the Sitecan be proven to befraudulent.
 
You must ensure that any information you provide to Book With Us is accurate and up-to-date, including any information which a third party may provide to us on the Site.
 
 Book With Us may block your access to theSite or the Products offered on the Site, if we reasonably suspectthat your activity is fraudulent or is in breach of these Terms.
 
Placing Orders
 
You may place an order for a Product offered on the Site after accepting these Terms and any Product Specific Terms.
The following steps set out the process for booking any Product:
 
1. You undertake a search on the Site.
 
2. Based on your search criteria, the Site will display offerings for Products.
 
3. If required, Book With Us will contact you to process the sale by telephone or email.If Book With Us is not required to contact you, you may select your chosen Product online.
 
4. A summary of your selection and the relevant price of the Product will be displayed to allow you to confirm the details of your Order.
 
5. You have an obligation to check the accuracy of the details in your Order (including date, time of day, origin and destination of your travel, name, mode and address of delivery, price, identity, age of travellers, etc.) Book With Us cannot modify an Order once it isis approved by us.
 
6. You may then review and approve your Order.By reviewing and approving your Order, you are making an offer to purchase the Product(s)chosen by you in your Order and you confirm that you accept these Terms and the Product Specific Terms.
 
7. You may need to pay for your Order online.
 
8. Book With Us, in the name of, and on behalf of,its Partners, will provide you with a receipt confirming your Order by email. Book With Us will do this as soon as possible and will aim to get this to you within five days of your Order.The email confirmation will show the details of your Order, including the Product ordered, the price, the quantity, the Product Specific Terms and these Terms.The contract is then valid and binding.The email confirmation will form part of the agreement between you and Book With Us, in the name of, and on behalf of, its Partners,unless you contest them by email within eight days of receipt of the email confirmation. The email confirmation may only be contested by you if they differ from the Order made by you.
 
9. If you do not receive email confirmation of the Order, you are responsible for contacting Book With Us.
You agree that you are responsible for the accuracy of the information (name, email, address, etc.) in your Order. You agree to immediately inform Book With Us in writing (including by email), of any change that could affect the Product, in order to ensure that the Product that you have ordered is correct. Name changes are not possible once a name has been provided in an Order.

2.2 DELIVERY

Except as otherwise set out in the Product Specific Terms and subject to Clause 3.1.1, the tickets and/or travel documents issued for a Product on the Site, are either to be retrieved or delivered to you, or printed according to the provisions specified in the Product Specific Terms.

2.3 EVIDENCE

Except if an obvious error has occurred due to an act or omission of Book With Us you agree that the data obtained by Book With Us and/or of its Partners, is legal evidence of an Order being made by you. Digital data obtained and stored by Book With Us may be produced as forms of evidence by Book With Us and will have the same validity as evidence as any data obtained or stored in writing.

2.4 CANCELLATION AND AMENDMENT

The Product ordered on the Site are subject to the conditions of cancellation and amendment set out in any applicable Product Specific Terms. You acknowledge that depending on the type of Product you order, and as set out in the Product Specific Terms, the Product may be non-refundable, or subject to cancellation or amendment fees. Any cancellation or amendment fees that may be charged by Book With Us or a Partner, is an amount that constitutes Book With Us or a Partner’s costs, time and effort in managing a cancellation or amendment of the Product by you. If you wish to cancel or amend a Product, please visit our website to make this change. You may also contact Customer Service of Book With Us by visiting the Contact page.

Clause 3. PRODUCTS

Products are offered by Book With Us in the name of and on behalf of its Partners. The Product Specific Terms relating to a Product are displayed when you make your Order. You agree to carefully and fully read the Product Specific Terms and accept the Product Specific Terms before you review and approve any Order.

3.1 Train tickets

Several types of Products are offeredon the Site.
Book With Us is not responsible for, and will not authorise reimbursement of,lost, stolen, damaged or destroyed Products (including the documentation of passes, train tickets or coupons).
Some tickets are personal to the person named on the ticketandthe ticketcannot be modified or transferred after purchase. A person may be required to presentfor inspectiona current valid photo identificationacceptable in the country of travel such as an identification card or a passport, and this must match the person named on the ticket.
 
In some countries, some tickets must be validated prior to entry on to the train. Tickets that May Be Printed at Home (referred to as “Print at Home Ticket”) Some Products offered on the Site may be purchased as a Print at Home Ticket. The Print at Home Ticket is a ticket that is sent digitally and that you may print yourself. This is a non-transferable ticket. If a person is the subject of an inspection on the train, the person must present a current valid photo identification acceptable in the country of travel, such as an identification card or a passport, and this must match the person named on the ticket. Print at Home Tickets do not have to be validated prior to entry on to the train, but the passenger must keep the Print at Home Ticket with them throughout the train journey. The Print at Home Ticket is valid only for the designated train, name, date, time, class and route. If you fail to comply with this clause, the Print at Home Ticket will be invalid. You are responsible for good quality printing and protection of a ticket. If a tickets is poorly printed or damaged, the ticket will not be valid. Prior to your purchase of any Print at Home Ticket, you are responsible for ensuring that you have the relevant software, hardware, network and equipment to print your ticket. Book With Us is not liable if you are unable to print your Print at Home Ticket for any reason.
 
“Collect at the station”
 
Tickets Some Products may be retrieved from self service terminals in stations. It is your responsibility to check if this option for retrieval is offered for the Product and if your itinerary allows for retrieval. Book With Us will send you reference information of your ticket by email. To retrieve your ticket, you will be asked to present this reference information as well as a debit/credit card.

3.2 RAIL PASSES

Rail passes allow travel on the national rail networks in one or more countries depending on the rail pass purchased.

This is a non-transferable ticket. If a person is the subject of an inspection on the train, the person must present a current valid photo identification accepted in the country of travel, such as an identification card or a passport, and this must match the person named on the ticket.

Some rail passes can only be sold to certain residents, and if you purchase such a rail pass, you warrant and guarantee that you have the relevant residency required to purchase the rail pass.

We recommend you check your itinerary to determine if additional train tickets must be purchased if a train passes through a country not covered by a rail pass.

Activation and use of your rail pass:

You must activate your rail pass within the time frame described at the time of purchase. To activate your rail pass, youmust presentit, and yourpassport, to the agents of the rail company in your train station of departure. Theagents of the rail companyare the only
agents authorised to activate rail passes. Once the rail pass is activated, the first day and last day of your rail pass validity will be determined. The rail pass holder will be required to sign the rail pass. For flexi rail passes, the rail pass holder will be required to write the date of travel prior to boarding the first train of that day. Rail pass holders who fail to comply with these conditions will be subject to a fine and payment of the full price train ticket.
 
Rail company conductors are authorised to confiscate rail passes and require payment of fine and the full price train ticket if there is reason to believe that a rail pass is no longer valid, has been modified, falsified or used by a person fraudulently. A passport must be shown to rail company agents when they are requested. A rail pass is usually valid from midnight to midnight for the period set out on the rail pass. Unless otherwise indicated, the rail pass cannot be used on hotel trains, private trains or special trains.

Reserving seats:

Holding a rail pass does not guarantee a seat on the train. We recommend you book seat reservations in advance, particularly if the train limits the seats available to rail pass holders. If you do not book a seat reservation in advance, you may be required to take another train (or opt to purchase another ticket). Seat reservations may be optional or mandatory. It is your responsibility to check any mandatory requirement for a seat reservation. High speed trains, international trains, night trains and scenic trains usually require mandatory seat reservation. Some trains require payment of a surcharge that includes a mandatory seat reservation. The cost of seat reservations vary.

Applicable rules:

If the rail pass is to be used in several countries, it will be subject to the “Uniform Rules concerning the Contract for International Carriage of Passengers and Luggage by Rail (CIV)”. Rules and regulations specific to a country may also apply for national passes.

The descriptions of the Products on the Site specify, for each Product, what isincluded in the price, including if any delivery fees and booking fees applicable.
The prices andcurrencies are presented on the Site.
 
The prices will generally include all taxes and fees, except handling and shipping fees which may vary dependingon theProduct selected.
Fees for foreign transactionsmay apply, including any fees or expenses from your bank or card issuer such as foreign transaction or conversion fees.You will be responsible for payment of these fees.Paymentof taxes or fees (tourist tax, visa fee etc.) may be required by some governments and are not priced in the Products. You will be required to pay any applicable additional taxesor fees.
The price does not include personal or additional expenses related to the Products,unless expressly stated in the booking confirmation. This includesinsurance and any other service not expressly included in the booking confirmation.
You may be responsible for fees that may arise due to baggage registration, handling fees, meals as well as seat reservations (for example, for sleeping car compartments).

4.2 PAYMENT

You agree to pay the price for the Products on the day an Order is made.

The amount for the Products (delivery fees and booking fees (if applicable) included) is generally charged at the time of your Order or when your travel documents are made available to you (including by mail).

Unless otherwise specified in the Product Specific Terms, payments are made directly to Book With Us on the Site using a credit or debit card or through our chosen payment processor (e.g. PayPal).

For irregular, incomplete or non-existent payments made by you, the sale of the Product will be cancelled and we may charge you expenses arising from cancellation.

Book With Us reserves the right to block any Order that in its reasonable opinion is fraudulent or where online payment security is compromised. Please contact Customer Service if you believe that we have unnecessarily blocked your Order.

Book With Us records the contact information provided during a purchase and in the case of irregularity we may block this contact information to make future Orders on the Site. We will notify you by email to allow you to correct the situation by contacting Customer Service.

4.3 EXCHANGE RATE

Book With Us provides no guarantee as to the exchange rate used for an Order and is not responsible for updating exchange rates displayed on the Site in real time.

Clause 5. PROCEDURES

You are responsible for being informed aboutadministrative and/or health procedures necessary for your travelor any requirements or restrictions that may affect your travel, prior to making your Order.
You acknowledge and agree that administrative and/or health procedures for your travel or requirements or restrictions that may affect your travel may change from time to time without notice and it is your responsibility to keep yourself informed of any change of this information.
You are responsible for carrying out and paying for the procedures required for your travel by the policeandcustoms and health authorities, includingvisas, medical certificates, vaccination certificate, etc.
You acknowledge and agree that if you do not meet any health requirements required by a Partner, or cannot presentthe relevant documentationto evidence any required health requirements, the Partner may deny your use of the Product. Please refer to the Product Specific Terms as to the Partner’s processes and procedures for refunds,cancellations or amendments.
You are responsible for ensuring your passport is valid for your travel. Some countries require that passportsbe valid for more than six months after your departure date.Minors must carryidentity documents in their name.
You agree that if you are not able to use the Product because of your failure to comply with administrative and health procedures, including those procedures described in this clause, the price paid will not be refunded.

Clause 7. INTELLECTUAL PROPERTY

7.1 OVERVIEW

All intellectual property (including copyright) developed, adapted, modified or created by us or our personnel (including in connection with the Terms, any content on the Site, and the Products) (Our Intellectual Property) will at all times vest, or remain vested, in us.

We authorise you to use Our Intellectual Property solely for your own personal, non-commercial use, and in the manner in which it was intended to be used. You must not use Our Intellectual Property for commercial purposes, including, for example, to advertise your own business, for re-sale, or for any other revenue generation activity.

You must not, without our prior written consent: copy, in whole or in part, any of Our Intellectual Property; reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any of Our Intellectual Property to any third party; or breach any intellectual property rights connected with the Site or the Products, including (without limitation) altering or modifying any of Our Intellectual Property; causing any of Our Intellectual Property to be framed or embedded in another website; or creating derivative works from any of Our Intellectual Property.

Nothing in the above clause restricts your ability to publish, post or repost Our Intellectual Property on your social media page or blog, provided that: you do not assert that you are the owner of Our Intellectual Property; unless explicitly agreed by us in writing, you do not assert that you are endorsed or approved by us; you do not damage or take advantage of our reputation, including in a manner that is illegal, unfair, misleading or deceptive; and you comply with all other terms of these Terms.

7.2 SOFTWARE

The use of any software downloaded from, or utilised by, the Site is governed by the terms of the third party software provider. You agree to comply with the terms of the third party software provider. If the software is provided by us, you are granted a temporary, private, personal, non-sublicensable, non-transferable and non-exclusive right to access the software in order to benefit from the software.

Clause 8. LIABILITY AND GUARANTEES

8.1 SITE

Book With Us does not guarantee that the Site will be free from errors or bugs, (including that these can be corrected), nor that the Site will function without interruption or breakdowns or be compatible with your hardware or software systems unless expressly agreed by Book With Us.

Book With Us has no liability for third party software, including if third party software does not operate.

Book With Us has no liability for any foreseeable or unforeseeable, material or immaterial loss (including the loss of profit or opportunity) arising from the part or whole inability to access the Site. Book With Us is not liable for hyperlinks on the Site, including any content accessed through the hyperlink. You understand the limits of using the Internet, including in relation to data transfers and data security.

You agree that you have checked your computer system and have determined that it is in functional condition to access the Site, and not subject to any virus.

8.2 PRODUCTS

Products are provided to you by Book With Us Partners. Despite anything to the contrary, to the maximum extent permitted by law, Book With Us cannot be held liable for, and you waive, release and discharge Book With Us from, any failure to execute or poor execution of all or part of the Products specified in the contract, arising as a result of, or in connection with, your act or omission, the act or omission of a third-party provider (including any Partner) or to a case of force majeure, unless the failure to execute or poor execution of all or part of the Products was caused directly by Book With Us

8.3 PRINT AT HOME TICKETS

Book With Us is not liable for irregularities that may arise when an Order is made, or in the processing or printing of a Print at Home Ticket.

8.5 GENERALLY

Despite anything to the contrary, to the maximum extent permitted by law:
1. Book With Us maximum aggregateliability arising fromor in connection with these Terms (including the Products and/or the subject matter of these Terms), will be limited to, and must not exceed, the portion of the price paid by you for the Product the subject of the relevant claim; and
 
2. Book With Us will not be liable to you for any loss of profit (including anticipated profit), loss of benefit (including anticipated benefit), loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings (including anticipated savings), loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

The personal information that you provide to Book With Us will allow us and our Partners to process Orders, and to manage any account you may set up on the Site. Book With Us will also use your personal information to manage subscriptions to our email marketing. All personal information you give to us will be treated in accordance with our privacy policy.

Clause 10. GENERAL PROVISIONS AND DEFINITIONS

If Book With Us does not assert, any one of its rightsin these Terms this will not be interpreted as a waiver of its right.
If a provision of these Termsis held to be void, invalid, illegal or unenforceable, that provision is to be read down as narrowly as necessary to allow it to be valid or enforceable, failingwhich, that provision (or that part of that provision) will be severed from these Terms without affecting the validity or enforceability of the remainder of that provision or the other provisions in these Terms.
Neither party may commence court proceedings relating to any dispute arising from, or in connection with, these Terms without first meeting with the other party to seek (in good faith) to resolve that dispute (unless that party is seeking urgent interlocutory relief or the dispute relates to compliance with this clause).
These Terms contain the entire understanding and agreement between you and Book With Us in respect of their subject matter.You must not assign any rights or obligations under these Terms, whether in whole or in part, without Book With Us prior written consent.
Any notice given under these Terms must be in writing addressed to Book With Us at the details set out on the Siteor to you at the details provided when you submitted your Order. Any notice may be sent by standard post or email, and will be deemed to have been served on the expiry of 48 hours in the case of post, or at the time of transmission in the case of transmission by email.
 
These Terms may be translated. Translated versions are only indicative and only the English version of these Terms is valid.

DEFINITIONS

“Order” means any booking made on the Site and approved by the User. “Product Specific Terms” means the terms and conditions specific to a Product accessible on the Site prior to approval of any Order by the User. “Partner” means any service provider providing a Product that is available on the Site. The term “Partner” includes rail carriers. “Products” means rail transportation tickets, such as train tickets or rail passes. Last Update: [1st Sept, 2023]
